A leaflets for observers:

The leaflet contains information taken exclusively from the Constitutional Law of the Republic of Kazakhstan "On elections in the Republic of Kazakhstan".

The instruction is intended first of all for the observers working on the day of voting at the polling stations, as well as for a wide range of people interested in the procedure of monitoring the election process in Kazakhstan.

The Leaflet consists of five sections describing the main stages of observation through the prism of potential violations of electoral legislation on the day of voting, namely:

Before the voting procedure*
Description of violation
  • 1
    Opening of the polling station ahead of schedule (before 06.00 hours).
  • 2
    The presence of ballot papers in ballot boxes before the voting process begins, ballot boxes must be transparent and complete.
  • 3
    The Chairman must seal the ballot box.
  • 4
    The room where the ballot papers are kept was not sealed.

Voting Room*

Description of violation
Violation of the conditions of the voting room equipment.
Availability of campaigning materials, as well as campaigning on the site by third parties.
Absence of the voter list at the polling station, failure to present the voter list to voters, observers.
Voting procedure*
Description of violation

    A ballot paper shall be issued to a voter after verification of the voter list and presentation of an identity document. After that, he shall sign on the ballot papers. The elector, in his turn, is to sign in the journal of bulletin receipt.
  • 2
    The chairman and the secretary of the election commission do not have the right to issue ballots.
  • 3
    Voting takes place in the cabin. There should be only one person in the cabin. If necessary, a voter's proxy may enter the booth.

    It can't be
    - an election commissioner;
    - an official of a local representative or executive body;
    - an authorized representative of the candidate;
    - journalist
    - a media representative;
    - an observer registered with the relevant election commission.

    Throwing of ballots at polling stations.

Outdoor voting*

Description of violation
The President shall notify observers of the organization of the vote outside the premises. The President shall be obliged to include an observer in the mobile voting group to vote outdoors if the latter so wishes.
The carry-over bin must be transparent, integral, sealed or sealed, with no ballots inside.
Determining the voting results*

    All unused ballots are counted and repaid before opening the ballot box

    The first to open the ballot boxes in turn. The number of ballot papers in the ballot box should correspond to the number of written statements cast outside the voting area.

    The results of vote counting shall be considered by the election commission and recorded in protocols, which shall be signed by the chairman and members of the election commission. In case the chairperson of the election commission is absent, the protocols shall be signed by the vice-chairperson or the secretary of the election commission instead.
  • 4
    It is not allowed to fill in protocols on voting results with pencil and ink of different colors, as well as to make any corrections in them. Thus numerical values of results of voting should be duplicated in prescriptions.

    The copy of the report shall be immediately posted in the premises of the polling station in a specially designated place for public inspection and shall be kept in the premises within two days.

    Upon the request of a person present in accordance with this Constitutional Law during the counting of votes, a copy of the minutes certified by the signatures of the Chairperson and the Secretary of the Commission and the seal of the election commission shall be issued to him/her

Article 20-1.
Observers of political parties, other public associations and non-profit organizations in Kazakhstan

П.1. Powers of an observer from political parties, other public associations, non-profit organizations of the Republic of Kazakhstan must be certified in writing with indication of his surname, name, patronymic.

This document shall be certified by the seal of the organization that sent the Observer and shall be valid upon presentation of the Observer's identity document.

The documents shall be submitted to the chairperson of the election commission or the person substituting for him/her for the registration of the observer by entering the data about him/her into the logbook.

Duties of the observer

    To have their identity and credentials with them.
  • 2
    Not to interfere in the election process, in the procedure of vote counting and decision-making by the election commission.
  • 3
    Do not take actions that interfere with the work of the election commission.
  • 4
    To comply with the requirements of the chairperson of the election commission on compliance with the rules of conduct at the polling station established by the respective election commission.
  • 5
    Base your comments on documented, valid and verifiable facts.
  • 6
    To comply with the requirements of the present Constitutional Law and other legislation of the Republic of Kazakhstan.
  • 7
    To keep an open mind, not to express a preference for a particular candidate, a political party.

Rights of observers

  • 1
    To attend the meeting of the election commission.
  • 2
    Receive information on the number of voters who took part in the voting, including in outdoor voting.
  • 3
    To be present in the voting room of the polling station during the voting and counting of votes.
  • 4
    Accompany portable ballot boxes, including being in the vehicle during transport.
  • 5
    To observe the voting process, the procedure of counting the votes and registration of the results of the voting at the polling station, in the polling station in conditions that allow for a clear review of all the listed procedures.
  • 6
    To appeal the decisions, actions (inaction) of the respective election commission and/or its members to a higher election commission or court.
  • 7
    To be present at the voting outside the voting room in case the voters are unable to arrive at the voting room.
  • 8
    To attend the counting and redemption of unused ballots by the members of the precinct election commission.
  • 9
    To make photo, audio and video recordings without interfering with the voting and summarizing the results.
  • 10
    To observe the procedure of passing the protocols on the results of voting to higher election commissions
  • 11
    After the voting to get acquainted with the protocols of the election commission on the results of the voting, to receive their certified copies
  • 12
    To draw the attention of the members of the election commission to violations of the requirements of this Constitutional Law, to present them with relevant written applications, acts on violations, and to receive notes on delivery. The Chairperson of the Electoral Commission, the person substituting him/her shall be obliged upon application of proxies, observers to attach to the minutes of vote counting the acts drawn up by them.
